E-mailing and legislation in 2023 or E-mail Restart for the second time

The conference, full of practical instructions and real-life examples from the world of email marketing, brought many aha moments and surprises in the form of different opinions and practices. We presented a little bit in the first part of this mini-series, today we continue and this time we enter the waters of legislation.

Legislation 2023: Button amendment also affects email marketing

Attorney Petra Stupková from Legitas.cz focused on four main points :

  • buttons,
  • SMS,
  • review,
  • discounts.

The topics arising from the button amendment line database do not seem to relate to e-mailing at first glance, but everything is related to everything.

Newsletter subscription buttons

The buttons from the amendment apply mainly to purchases and orders, however, you also use buttons and checkboxes when collecting email contacts , so a little repetition won’t hurt. Who can you send newsletters to?

  1. To recipients who have given consent.
  2. To customers who had the opportunity to disagree.

The first point is clear, this is a classic subscription to NL , whether via the website or social networks.

In the second case, it is a customer who you whatsapp data informed during the order that they were subscribing to the subscription, but at the same time you gave them the option to refuse it .

And be careful about one more thing. You should send customers in NL an offer of similar or related goods (services) that they purchased data artist: a key piece for your company from you. If an e-shop with shoes takes advantage of the situation during the Covid period and also starts selling respirators, it cannot send these goods to existing customers in NL. And vice versa – if it gains new customers thanks to respirators, it cannot then offer them shoes in NL.
